Google runs the backend network that places ads on the sites relevant to site content. For now, some users are either learning to live with workarounds or sticking with Vista's predecessor, Windows XP.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Pirillo is geekier than the average user. He runs a network of technology blogs called Lockergnome, and was one of several "Windows enthusiasts" Microsoft asked for Vista feedback early on.&lt;br /&gt;Still, Vista tested even Pirillo's savvy. He fixed the hobbled printer and other problems by installing VMware, a program that lets him run XP within Vista. But when his trial copy expired, he decided the solution was too clunky — and too expensive.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;He "upgraded," as he called it, back to XP.&lt;br /&gt;Users' early complaints aren't a threat to Microsoft's dominance in operating systems. The various flavors of Windows run 93 percent of PCs worldwide, according to the research group IDC. Last fiscal year, Windows accounted for about a third of Microsoft's total revenue of $44.3 billion.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Industry analysts say Vista adoption is plodding along as expected, with most consumers and businesses switching over as they replace old hardware with new. IDC analyst Al Gillen said he expects Vista will be installed on the vast majority of computers in about five years, the time it took for XP to reach 84 percent of PCs.&lt;br /&gt;It's too early for industry watchers to know exactly how many people are using Vista. At the same time, it's hard to gauge Vista's success by comparing it to XP, because the PC market has grown tremendously in the last six years.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;I&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;n early May, Microsoft said it had distributed 40 million copies of Vista, which costs $199 to $399 depending on the version. But it did not specify the number actually sold through to consumers, versus those shipped to computer makers like Hewlett-Packard Co. and Dell Inc.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Analysts noted that as many as 15 million of those copies could represent upgrade coupons given to XP buyers during the holidays, before Vista went on sale. Microsoft would not say how many of those customers installed the new system, but Forrester Research analyst J.P. Gownder estimated just over 12 million U.S. consumers would have Vista by the end of the year, out of about 235 million PCs in the country.&lt;br /&gt;As for the compatibility problems, 2 million devices — such as cameras and printers — now work with Vista, said Dave Wascha, a director in the Windows Client group.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"We are way ahead with Windows Vista right now than where we were when we shipped Windows XP," he said.&lt;br /&gt;Still, it's an uphill battle: Vista interacts differently with programs and peripherals than previous versions of Windows, and some companies have chosen not to spend time and money updating older products. Printer makers, Wascha noted, draw profits from ink cartridges and services, and have little motivation to invest in updating drivers for old hardware.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;As a result, many early adopters have made a sport of grumbling about the one device or program they still can't get to work.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;And they've ranted about other things, from how hard it is to open Vista's snap-together plastic retail box, to what they see as arbitrary decisions on Microsoft's part to hide common settings and features.&lt;br /&gt;One of the most common annoyances: Microsoft's user account control feature, designed to protect unwitting Web surfers from spyware and viruses that would otherwise install themselves on the hard drive.&lt;br /&gt;Dan Cohen, chief executive officer of Silicon Valley startup Pageflakes, bought a Vista laptop a couple of months ago. After one too many pop-up windows warning of possible threats from the Internet, Cohen switched the control feature off.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;&lt;/span&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Now he gets pop-ups warning him that turning off UAC is dangerous.&lt;br /&gt;"I feel more secure — and more irritated," he said. When Cohen went to buy his wife a new computer in April, he stuck with XP on a laptop from Lenovo Group Ltd.&lt;br /&gt;Some analysts say Microsoft hasn't put enough energy into marketing Vista's benefits to consumers. But it may also be the case that Vista's biggest benefits are ones that cause average PC users' eyes to glaze over, like improved security.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"Everybody wants there to be a repeat of Windows 98 — the excitement, the sales volume, the rate of growth and everything else," said Michael Cherry, an analyst for the independent research group Directions on Microsoft.&lt;br /&gt;At the time of Windows 98's launch, broadband access to the Internet was catching fire and consumers were pumped up about getting a faster, cheaper computer.&lt;br /&gt;There's no such compelling reason to buy Vista, said Gownder, the Forrester analyst.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Businesses, like consumers, are in no hurry to upgrade. Before the business version of Vista landed late last year, a Forrester survey of about 1,600 companies found that 31 percent planned to upgrade within a year, and 22 percent more planned to be running it within two years.&lt;br /&gt;Most businesses think those plans now seem too aggressive, said Forrester analyst Benjamin Gray.&lt;br /&gt;While corporate technology departments are looking forward to some of Vista's security features and easier administration tools, there's little reason to switch if more secure PCs end up choking on a critical piece of software.&lt;br /&gt;"They're waiting for Microsoft to bless it with a service pack," said Gray, referring to a major software update that fixes bugs.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The University of Pittsburgh Medical Center, a member of Microsoft's Vista Technical Adoption Program, started evaluating Vista in January 2006. Today, only 300 of the hospital's 30,000 desktop computers run the software.&lt;br /&gt;Karen Malik, associate director of technical services, said the rollout is behind schedule because several key programs still aren't compatible, including patient scheduling software. Malik knows the software vendors will catch up to Vista — someday. In the meantime, she's not rushing.&lt;br /&gt;"We know eventually we're going to need to move to this operating system," Malik said. Apple itself has set a target of selling 10 million units worldwide by 2008, gaining roughly a 1 percent share of the cell phone market.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The phone was sold out in most Apple and AT&amp;T stores by Monday afternoon, said AT&amp;amp;T spokesman Michael Coe. He declined to release specific sales figures.&lt;br /&gt;Coe added that most of the activation problems that surfaced over the weekend had been resolved. Some iPhone buyers had trouble switching over to AT&amp;T from their previous wireless carrier, delays that AT&amp;amp;T blamed on overloaded servers, a problem with the company's credit authorization system, and problems transferring customers' business accounts to consumer accounts.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"The issue is essentially behind us now," he said.&lt;br /&gt;But as that problem passed, another glitch emerged. Some iPhone users in Western and Midwestern states were unable to get onto the Internet for several hours Monday because of outages on AT&amp;T's EDGE network that were eventually fixed, Coe said. AT&amp;amp;T said it had not determined what caused the outages but was certain it wasn't due to an influx of iPhone users.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Despite the problems, investors flocked to the iPhone's newly unmasked parts makers.&lt;br /&gt;Among the beneficiaries of Apple's business and the tear-down buzz were semiconductor heavyweights Intel Corp., Broadcom Corp., Texas Instruments Inc. and Infineon Technologies AG as well as lesser-known companies such as Skyworks Solutions Inc. and Linear Technology Corp.&lt;br /&gt;Some researchers said Apple's secrecy surrounding the iPhone's component suppliers is yet another example of the Cupertino-based company's vaunted ability to keep their partners tightlipped even when facing a media frenzy and rampant speculation.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"They're very good at it — and I think they make a point of holding their suppliers to a standard of secrecy, or you could lose the next round if you slip up," said Howard Curtis, vice president of global services for Portelligent, a research company.&lt;br /&gt;The secrecy continued Monday. Several analysts also published the results of their own tear-downs.&lt;br /&gt;Based on the results, one of the biggest winners is South Korean chip maker Samsung Electronics Co., which is making the main microprocessor used to run the phone's operating system and various applications. Samsung, the world's largest memory chip manufacturer, is also making a type of memory called NAND flash for the iPhone.&lt;br /&gt;Santa Clara-based Intel, the world's largest semiconductor company, is supplying another form of memory, called NOR flash, according to various research firms.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Intel is in the process of unloading its troubled unit that makes the memory, which is primarily used in cell phones, amid fears about its long-term viability with the rise of NAND flash, a cheaper alternative that's commonly found in digital cameras and music players.&lt;br /&gt;Intel's stock rose 53 cents, or more than 2 percent, to $24.27 in Monday trading.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Other chip makers whose stock rose on their involvement with the iPhone included Irvine-based Broadcom Corp., which is making a controller chip believed to be used for managing the touch-screen display. Broadcom's stock price rose 52 cents, or 1.8 percent, to $29.77.&lt;br /&gt;Texas Instruments is supplying a power-management chip. Shares of TI gained 43 cents, or 1.1 percent, to $38.06.&lt;br /&gt;German chip maker Infineon Technologies, which makes parts that handle cellular communications for the iPhone, saw its American Depositary Shares rise 50 cents, or 3 percent, to $17.03.&lt;br /&gt;But it wasn't just the heavyweights who benefited.&lt;br /&gt;Woburn, Mass.-based Skyworks Solutions Inc. was revealed as the supplier of a power amplifier used in the iPhone. Skyworks' shares jumped 26 cents, or 3.5 percent, to $7.61.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Shares of Milpitas-based Linear Technology Corp. rose 50 cents, or 1.4 percent, to $36.68 after the company was identified as the maker of the iPhone's battery charger chip.&lt;br /&gt;Another company profiting from the iPhone is Cambridge Silicon Radio Ltd. out of England. Researchers said the company is responsible for making chips that allow Bluetooth wireless connectivity for the iPhone.&lt;br /&gt;But the iPhone halo didn't touch everyone Monday.&lt;br /&gt;Apple, for one, fell 78 cents, or less than a percentage point, to $121.26.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Shaw Wu, an analyst with American Technology Research, attributed the slight drop to profit-taking after a prosperous run over the past year, during which Apple's stock price has more than doubled. On Monday his firm raised its price target for Apple to $165 per share.&lt;br /&gt;&lt;/div&gt;&lt;/span&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Marvell Technology Group Ltd., the Santa Clara-based provider of chips that allow the iPhone to connect over Wi-Fi networks, dropped 13 cents, or less than a percentage point, to $18.08. No reason to worry, these changes are all good news for CCNA candidates.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;And the first bit of good news is that you have plenty of time to take and pass the current CCNA exams. In this article, I will outline several advantages to taking the CCNA plunge now before these changes take effect.&lt;br /&gt;The current CCNA exam (640-801) will not be phased out until November 6, which gives you more than enough time to get CCNA certified before then -- even if you haven't started studying yet! Those of you who want to take the two-exam path to CCNA certification should know that the 640-811 ICND and 640-821 INTRO exams will be phased out on that same date.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Cisco's taking the approach that the CCNA certification is no longer an entry-level certification, and this is a welcome change for CCNAs and CCNA candidates alike. I have been writing CCNA ebooks and teaching CCNA courses for several years, and I've always refused to call this an entry-level certification.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The new CCNA exam (640-802) looks to be even more demanding than the current exam, which is another reason to pick up the pace and get certified now! EA will consist of units that focus on sports, casual games, its "Sims" virtual dollhouse franchise, and other games.&lt;br /&gt;EA said the changes, which will not involve job losses, should help it save money at a time when the cost of developing a top-tier game can run up to $20 million.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"It makes a lot of sense. It streamlines the company," said Todd Greenwald, an analyst with Nollenberger Capital Partners.&lt;br /&gt;"It goes with Riccitiello's desire to make people more accountable. When a game misses a deadline, when the quality is bad, he wants one person to explain why," Greenwald said.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Riccitiello, the company's former chief operating officer who left in 2004 and rejoined in April, said last month that he intended to realign the company and improve its ability to act quickly.&lt;br /&gt;"He's had a very strong and aggressive change agenda and what he's been framing as a challenge to the management team is that we are facing a market that is incredibly diverse and complex," said Frank Gibeau, head of the new EA Games unit.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The change "streamlines decision-making, increases speed to market, enhances accountability and allows us to be more experimental, so we can really open up and leverage our scale long-term," Gibeau said in an interview.&lt;br /&gt;The changes, based on the success of a pilot program that placed games based on "The Sims" franchise into their own unit, mean it will require fewer executives to sign off on new games or to approve launching an existing game on a different platform or in a different regions.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"We ran an organizational experiment and it was pretty damn successful. The Sims grew aggressively," Gibeau said.&lt;br /&gt;Gibeau will be in charge of the largest unit of EA games, including its "Battlefield" series of online shooters, "Need for Speed" street-racing titles, and its "Command &amp; Conquer" strategy games.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;EA Sports, which includes the company's "Madden" football, "Tiger Woods PGA Tour" golf and "NASCAR" racing games, will be run by Executive Vice President Joel Linzner until a permanent head can be found.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Earlier this month, EA recruited Kathy Vrabeck, former head of publishing for rival Activision Inc., to run its casual games unit. E-mail recipients who open the attachment to this e-mail can download malicious spyware onto their computers, the FTC said.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Recipients shouldn't open the e-mail; instead they should delete the message, the FTC advised.&lt;br /&gt;The hoax e-mail is personalized, containing the name of the recipient and their business. The bogus message explains how the complaint will be used and says, "Attached you will find a copy of your complaint. "We're doing things all over the country and speaking about the issue."&lt;br /&gt;Nelson made Internet safety her platform issue, prompted in part by an experience she and two of her friends had with a stranger they encountered on the Internet when they were about 13.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"We were chatting innocently on the computer when we were approached by an older gentleman," the Lawton beauty queen said. "He later sent inappropriate pictures of himself, and that's when we alerted our parents.&lt;br /&gt;"If it was a problem seven years ago, it's an even bigger problem now."&lt;br /&gt;In April, Nelson helped investigators in Suffolk County, N.Y., with an undercover sex sting. Eleven men were arrested after Nelson created an online profile of a 14-year-old girl that included photographs of her as a teenager.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"Doing the sting operation really opened my eyes to the way these predators work," Nelson said. "They can be any age, look any way and have any background."&lt;br /&gt;While parents may fear the prospect of their children being approached by a stranger on the Internet or lured away to a face-to-face meeting, a much more common danger for children on the Internet is cyberbullying, said Marian Merritt, an Internet safety advocate for Cupertino, Calif.-based Symantec.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Merritt described cyberbullying as using the Internet or digital technology to harass someone by posting things like hurtful comments, misrepresentations or unflattering photos. With the growing popularity of social networking sites like MySpace, surveys show more than 40 percent of teens have experienced some form of cyberbullying in the last year, Merritt said.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"These things can be incredibly damaging, especially to a young child," she said. Ted Strickland said.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;An additional review of data revealed that the storage device also held information on 53,797 participants enrolled in the state’s pharmacy benefits management program, as well as names and Social Security numbers of about 75,532 dependents, the governor’s office confirmed Saturday. It will also be available at launch on Apple's Web site.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The device goes on sale at 6 p.m. local time in each U.S. market.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;AT&amp;amp;T spokesman Fletcher Cook said the limited availability will only be for the initial launch. The application must have an offline component so that it can be used even if a major disaster knocks out Internet access.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The application will be used to manage the list of local Red Cross volunteers, and will contain these people's contact information along with their skills.&lt;br /&gt;Once completed and implemented in the Red Cross' Capital Area Chapter of Florida, the application will be pitched for adoption in Red Cross offices nationwide.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"Ensuring that a Web application such as this works during a disaster regardless of the outside [Internet access] networks being down is of top priority," Hand, a Red Cross volunteer IT coordinator, said via e-mail.&lt;br /&gt;Gears, an open source browser extension, contains three components. The first is a local server for caching and delivering "application resources" like HTML and JavaScript without a server connection. The second piece is a database that will allow for storing and accessing data from within the browser. The final component is what Google calls "a worker thread pool," designed to boost Web applications' responsiveness by carrying out operations in the background.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Before Google released Gears at the end of May, Hand was considering hosting the volunteers' database physically in the Red Cross offices for offline access.&lt;br /&gt;However, the chapter lacks the infrastructure to have database access on site. Its Web hosting company could house the database, but then it would be located off site and possibly unavailable in the event of a disaster.&lt;br /&gt;"Google Gears would allow us to use our existing infrastructure-- our off-site database-- in the event of Internet connectivity failure, allowing us to continue to provide expedited service to the victims," Hand wrote.&lt;br /&gt;He acknowledges that Gears still needs significant improvement for usage in production applications, something Google has also made clear.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Although &lt;/span&gt;&lt;a href="http://gears.google.com/" rel="nofollow"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Gears is available&lt;/span&gt;&lt;/a&gt;&lt;span style="font-family:arial;font-size:85%;"&gt; to anyone as a free download, at this point it's intended mostly for developers who can give Google feedback to improve the product. Google also hopes to push Gears as an industry standard for offline access to Web-hosted applications.&lt;br /&gt;Another developer with high hopes for Gears is Brandon Kraft from the University Catholic Center campus ministry of the University of Texas at Austin.&lt;br /&gt;Kraft hopes Gears will allow him to give an offline component to a variety of Web-hosted resources available to university students and staff.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Like other early testers, Kraft plans to wait for Gears to mature before using it in production applications. So far, he has run into a few kinks, including a clunky synchronization indicator.&lt;br /&gt;Kraft also stumbled with a known issue that has prevented proxy server users from installing Gears. After the installer failed twice on him, Kraft put Gears aside. A week later, he delved into the issue and, after 20 minutes, worked around it.&lt;br /&gt;"For the average consumer, once they get an error message [during the installation], they won't come back," Kraft said in a phone interview.&lt;br /&gt;The proxy server issue, flagged repeatedly in discussion forums, has caused some developers to take Google to task, a sign that with the high expectations also come strong feelings. Many corporate developers connect to the Internet via a proxy server.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;However, by the end of next week, the installer's problem with proxy server connections will be solved for most users, a Google spokesman said Friday.&lt;br /&gt;Google already started updating its servers with the latest version of the Gears installer, and some users have downloaded it already.&lt;br /&gt;"The update will be finished by next week, at which point you can be sure of getting the latest version of the installer from the Gears Web site," the spokesman said via e-mail.&lt;br /&gt;Despite its bugs, Gears has also generated enthusiasm among IT security experts.&lt;br /&gt;"I strongly believe that light footprint on the end-point device-- the user's computer-- makes for strong security. Because of that, I always prefer Web applications to installed applications," Maxime Rousseau, a security consultant with Sociiti Conseil Lambda Inc. in Quibec, Canada, said via e-mail.&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Despite liking Google's Docs &amp; Spreadsheets Web-hosted application suite, Rousseau doesn't recommend it to clients, saying that it's not fast enough due to Web pages' lagging responses. But last year, the&lt;br /&gt;U.S. Supreme Court handed a victory to patent-reform advocates when it ruled that MercExchange was not automatically entitled to a court order blocking the offending service.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Now, U.S. District Court Judge Jerome B. Friedman must decide whether MercExchange is entitled to a permanent injunction. The judge did not say when he would rule.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Friedman also did not immediately rule on eBay's request to stay the proceedings until the federal patent office has completed a re-examination of the patent — a process that MercExchange's lawyers said could take 10 years.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Lawyers for San Jose-based eBay told the judge that the company has designed a workaround so that it no longer infringes on the patent and thus an injunction is unnecessary.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Attorney Jeff Randall also said MercExchange has not suffered irreparable harm and that the company is better off now than it was before the trial, citing an investment by a hedge fund.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;MercExchange's attorneys, however, argued that the potential for future infringement is at stake and that MercExchange will not be able to sell exclusive licenses for use of its patent without an injunction.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"Without an injunction in the face of an infringing monopolist that now has 95 percent of the market, MercExchange cannot make productive use of its patent in any way," lawyer Seth Waxman said.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;Randall said an injunction would give MercExchange "illegitimate leverage," hurting eBay's reputation in the marketplace by making people think eBay is still infringing the patent.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"That's what they want," Randall said of MercExchange.&lt;br /&gt;Randall also said MercExchange is not interested in building its business.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"They sit back and try to collect from businesses for their patents, and that is it," he said.&lt;br /&gt;In arguing for a stay, Randall said waiting for the outcome of the patent re-examination would save a lot of litigation in the meantime.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;"I get the impression that, in a nice legal way, the court is being threatened," the judge said.&lt;br /&gt;MercExchange attorney Greg Stillman said it was wrong to wait for patent authorities to sort everything out and that eBay could have avoided a lot of litigation by asking for the re-examination much earlier.&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The patent battle focuses on eBay's button for buying products at a fixed price, bypassing the bidding process, and MercExchange's claim that the technology infringes on its intellectual property.&lt;br /&gt;The federal jury that sided with MercExchange awarded the company $35 million. The amount later was reduced to $25 million. Stillman said outside court that MercExchange intends to ask the judge to increase the damages to take into account infringement since the 2003 trial.&lt;br /&gt;&lt;/div&gt;&lt;/span&gt;&lt;br /&gt;&lt;div align="justify"&gt;&lt;span style="font-family:arial;font-size:85%;"&gt;The Supreme Court's ruling does not affect the judgment against eBay.&lt;br /&gt;In the closely watched case, the high court ruled that judges have flexibility in deciding whether to issue court orders barring continued use of a technology after juries find a patent violation.
